Intellectual Property


If a business wanted to trademark it would cost them £500,000,000 million to do this all over the world.
China is renown for watching British business and trademarking them in China before the British business  to gain the reparation of that brand.
A trademark must:
  • Have a graphical represntation 
  • Be capable of distinguishing itself as a good/service 
  • Be distinctive not descriptive 
  • Not be contrary to public policy/morality 
A trademark will last 10 years and can only be kept for 5 years and not be used.
The benefits of having a trademark:
  • Is that it stops infringement 
  • It prevents products/services having identical marks
  • Confusion 
  • It stops business stealing each overs reputations  therefore stoping a bhusiness gaining an unfair advantage and detriment
Logo's consist of:
  • Shapes
  • Colours
  • Sounds
  • They should distinguish  
Logos enable a business to:
  •  Stop other business passing off work as their own 
  • Protect their reputation
  • Stop misrepresentations
  • Prevent damage to their business  
Patents last for 20 years and are used to protect innovations they must:
  • Be new innovations and inventive
  •  Involve and inventive step
  • Capable of industrial application 
  • Be able to be made or used in some industry 
Patents consist of:
  • A description of the inventions and variations 
  • What the invention is what it is set out to do
  • what is protected 
Copyright protects work that falls into specific categories such as art, music and literary. As long as it is original it is automatically protected and will last 50-70 years 
An original is described as:
  • Having to be created using a skill or effort
  • It must not be a copy
  • Derivative work can be considered originals  
Exception to copy right are:
  • Non commercial research and private study
  • Criticism and review
  • Reporting current events 
  • Teaching in schools and colleges
